These Terms and Conditions (“Terms”) govern your access to and use of the website located at https://www.extracurricularsllc.com (the “Site”) and the purchase or use of any products offered by Extracurriculars, LLC (“Extracurriculars,” “we,” “us,” or “our”), including the VeloxiTuner.

By accessing the Site or joining our waitlist, you agree to be bound by these Terms. If you do not agree, you must cease using the Site immediately.

1. Ethical Data Commitment

Consistent with our Privacy Policy, we do not engage in the sale of user data or the use of invasive third-party tracking pixels. Our business is built on the engineering and sale of the VeloxiTuner, not the monetization of your personal information. We use service providers like Vercel and Brevo only to the extent strictly necessary to provide a functional, secure experience.

2. Product Information and Sales
  • The VeloxiTuner: The Site provides information regarding our physical consumer product, the VeloxiTuner.
  • Waitlist: By joining our waitlist via Brevo, you are requesting information about future product releases and pre-sale opportunities. Joining the waitlist does not guarantee the availability of a product or a specific price.
  • No Current Transactions: The Site does not currently offer checkout or payment processing functionality.
3. Intellectual Property

All content on this Site—including text, graphics, logos, and the design of the VeloxiTuner—is the exclusive property of Extracurriculars, LLC and is protected by copyright and trademark laws. You may not reproduce or distribute our content without express written permission.

4. Product Liability and Disclaimer

The VeloxiTuner is a physical consumer product. By purchasing or using the VeloxiTuner, you acknowledge and agree to the following:

  • Intended Use: The product must be used strictly according to the provided instruction manual. Extracurriculars, LLC is not liable for damages resulting from misuse, unauthorized modification, or neglect.
  • Limitation of Liability: To the maximum extent permitted by law, Extracurriculars, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use or inability to use our products, even if we have been advised of the possibility of such damages.
  • Maximum Liability: In no event shall our total liability to you for all damages exceed the amount paid by you for the specific product giving rise to the claim.
5. Mandatory Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

  • Binding Arbitration: You and Extracurriculars, LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the use of the Site, or the purchase of the VeloxiTuner shall be settled by binding individual arbitration rather than in court.
  • Arbitration Provider: The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
  • Waiver of Jury Trial: You acknowledge that by agreeing to arbitration, you are waiving your right to a trial by jury or to have a judge decide your case.
  • Class Action Waiver: You agree that any arbitration shall take place on an individual basis. Class arbitrations and class actions are not permitted. You waive the right to participate as a plaintiff or class member in any purported class, collective, or representative proceeding.
  • Exceptions: Notwithstanding this agreement to arbitrate, either party may: (1) bring an individual action in small claims court; or (2) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
6. Governing Law

These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State in which Extracurriculars, LLC is registered, without regard to its conflict of law principles.

7. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose.
  • Attempt to interfere with the proper working of the Site or the servers hosted by Vercel.
  • Submit false or misleading information through our contact forms or waitlist sign-ups.
8. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of changes by posting the updated Terms on the Site and updating the Effective Date. Your continued use of the Site after such changes constitutes acceptance of the new Terms.
